☞ Wills / Won'ts

✎ I draw animals, anthros, humanoids, pets, insects/bugs, body horror, living/mobility aids (do not count towards prop fees), any real species, blood, minor injuries
✎ I might decline humans, characters/species based on video games or shows (i.e. minecraft, ponies, sonic, etc.), non-harmful drugs, realistic armor/technology
✎ I do not draw explicit content, fetishes, intense gore, real people, sfw nudity, fanart, illegal/harmful drugs, hate art, realistic firearms

✧ Important

· must provide a clear visual reference
· feel free to send me doodles, pinterest boards, and toyhouses
· i have the right to refuse any commission

☞ General

· USD via PayPal Invoice. CashApp, or Stripe
· FULL payment must be made within 48 hours of having the order accepted, anything later may result in a delayed turnaround
· feel free to ask for progress at any point
· my turnaround is usually 3-14 days, but it can take up to 2 months with a full queue and/or larger commission requests
· i usually post wips on Trello, but will directly provide them to the commissioner if requested OR if i have a question
· i do not prioritize chronologically, however i am willing to work within a deadline, but only for special occasions (i.e. anniversaries, holidays, etc.), please give me at least 10 days in advance!
· the holder of the paypal account must be at least 18 years old
· i am not responsible for the client's actions or misuse of a paypal account
· i am willing to make 1-2 simple changes after completion

by ordering a commission or completing a transaction, you have thoroughly read and agreed to all of the terms listed. you acknowledge that filing a chargeback or not properly completing transactions goes against this agreement and that you relinquish rights to the work I have provided

Refund Policy

☞ Refund Policy

· i only offer full refunds if i physically cannot finish a commission
· if you back out of a commission that has not yet been started, I will issue a 80% refund
· if you back out of a commission that has already been started, I will issue a 65% refund
· i cannot offer refunds for finished or fully lined commissions, but will provide the work i've done so far if requested
· if you are unsatisfied with a custom at any point, i am willing to refund 90% as long as i get to keep the design for personal use or make it into an adopt

☞ Art & Design Usage

· do not claim my work as your's or someone else's
· do not heavily reference, trace, or replicate my work without my permission
· please refrain from intentionally obscuring or cropping my watermark
· the owner of a design may redesign, delete, gift, trade, or sell it at any value whenever or to whomever
· my art is intended for non-commercial, personal use only; however my designs may be used commercially without asking for permission
· explicit scalping, creating breedables, copying, scamming others, or using my art in a hateful way will result in a blacklist
· having a ToyHouse is not mandatory, but it is preferred
· please do not submit redesigns as a separate character on ToyHouse
· my art and designs cannot be revoked by ANYONE if they were legitimately obtained by the current owner, even if they are on a blacklist
· new terms cannot be attached to my work by the previous owner. all autonomy/rights go to the current owner
· adding filters, cropping for icons, etc. to my art are fine! feel free to edit the art of designs you own to any extent as long as you credit me for the original
· it is the responsibility of anyone who uses my art to distinguish my work from other media through properly crediting (art/design © Pathomime/Tourlamise)
· do not sell my work for NFTs
· do not feed my work to AI
· i am allowed to post, publicize, or promote commissioned work

☞ Holds & Payment Plans

· down payments are non-refundable
· down payment must be 35% of full price and paid within 48 hours of being accepted
· remaining payment must be made within 10 days of claim being made, or else it is reopened/removed altogether
· please tell me if you want to back out of an order/payment plan. i cannot provide refunds for payment plans, but i will not hold it against you if you let me know as soon as possible
